These Terms and Conditions (“the Terms and Conditions”) govern your (“User”) use of the MTB Coffee Pty Ltd (“Provider”) website located at the domain name www.mtbcoffee.co.za (“the Website”). 

By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out and including the Terms and Conditions Third-Party service providers, in this legal notice.

The User may not access, display, use, download, and/or otherwise copy or distribute content, obtained on the Website for marketing and other purposes with the consent of the Provider.

MTB Coffee Pty Ltd is not affiliated with, endorsed, or sponsored by NESPRESSO.

All third-party services provided through the Website are provided by well-established suppliers:

Please read these Terms and Conditions or Services carefully before accessing or using our website.

By accessing or using any part of our site, you agree to be bound by these Terms of Service. If you continue and make a purchase, it is understood that you have read and agreed to all Terms and Conditions as set out.

Any new features, tools, or products added to the current store shall also be subject to the Terms and Conditions and Services. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions and Services. This includes price changes and the change of service providers if need be.

We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of a Service.

Any malicious damage, breach, or violation of any of the Terms will result in immediate termination of access. We reserve the right to refuse service to anyone for any reason at any time.


Electronic Communications

By using this Website or communicating with the Provider by electronic means, the User consents and acknowledges that any, and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.


E-Commerce & Privacy

The Website www.mtbcoffee.co.za, sells coffee beans, coffee capsules, XS Food Snack Bars, and automated coffee machines. online. The use of any product or service bought from this Website is at the Purchaser’s risk. The Purchaser/User indemnifies and holds the Provider harmless against any loss, injury, or damages that may be sustained because of a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit/debit card details, delivery address, and phone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is, the delivery address and contact phone number, will be made known to third parties delivering the product. Credit/debit card details are not kept by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (personal computer or any other electronic device used to browse the Website), which may result from the lack of adequate virus protection software or spyware that the User may have inadvertently installed on his/her device.

The Provider will supply all goods to the courier/delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

All online credit/debit card payments are processed by Yoco. Please visit www.yoco.co.za to view the Security and Privacy policies.


Electronic Funds Transfer (EFT)

If the User selects to pay via EFT, instructions will be provided on how to make a transfer to the MTB Coffee Pty Ltd bank account, and the User will be subject to the following rules:
1. The exact amount must be paid.
2. The payment must be identified by supplying the order/invoice number and surname in the reference section on the electronic transfer.
3. Select the PAY NOW option.
4. Orders will be cancelled after 3 days, the estimated clearance time provided by the financial institutions.
5. Payments to (NO CASH PAYMENTS) MTB Coffee Pty Ltd, BANK is First National Bank.
6. Account number 62830316560 and Branch Code 250655.


Shipping and Delivery

MTB Coffee Pty Ltd offers a door-to-door service through our affiliated logistics partners, delivering to all major centers throughout South Africa with 3 – 7 workings (please note that this does not exclude public holidays or weekends to local areas within a 20km radius of the office) Outlying areas might take longer, depending on the affiliated logistics partners.

All orders placed during the weekend will be processed the following Monday, subject to stock availability. Please note that while MTB Coffee Pty Ltd does not deliver to remote farm addresses, we are, unfortunately, unable to deliver to PO Box addresses. 

Bear in mind that certain special orders, such as custom products, and special configurations and orders will take longer than usual to deliver, due to varying lead times.

Please note that should you select the incorrect rate based on your shipping address, we will cancel your order at our discretion.


Receiving Deliveries

Please note that any competent person at your delivery address may sign for your package, albeit at our courier’s sole discretion. Please note when purchasing from MTB Coffee, you are obliged to conform to our Terms and Conditions.

Please ensure that you read, understand, and agree to our Terms and Conditions before making purchases with us, you are indicating that you have read and understood the Terms and Conditions that apply to your purchase.

Should you have any questions regarding your purchase or delivery, our Terms and Conditions, or any matters relating to our website, please do not hesitate to contact us.


Order Collection

All collections are to be by prior arrangement. All collections are to be fully paid for prior to pick-up.

If a third party is sent for collection, full details, Name & Surname, ID number, and a contactable mobile number are to be provided prior to pick-up. No unpaid orders will be released.


Return and Refund Policy

Is your MTB Coffee order incorrect? Please accept our deepest apologies for the inconvenience.

Please contact us immediately and will sort it out as soon as possible. Coffee is essential and you cannot be without it!

Please note that if you would like to return your order due to a change of mind, please return the unopened package within 7 days. Cancellation of orders by the User will be subject to a 10% charge for administration costs. Simply arrange for the full order to be delivered to our Cape Town office, at Blouberg (at your cost), or bring it back yourself, and we will make sure you are taken care of.

In cases of unavailability, the Provider will refund the User if the User does not wish to wait until the said product is available again. Refund will take place within 7 working days. (Weekends not included).

The Provider reserves the right to cancel an order for which payment has already been received. This may occur due to insufficient stock or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions. 

Any complaints regarding the standard and quality of the product or products bought by the User through the e-commerce facility should be directed to [email protected].


Copyright and Intellectual Property Rights

The Provider supplies certain information on this Website. Content currently or in the process of being displayed on this Website is supplied by the Provider, its affiliates and/or subsidiaries, or any other third party owners of such Content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions, and Computer Programs (“the Content”). 

All such proprietary works, and the compilation of proprietary works, are Copyrighted by and intellectual property of the Provider, its affiliates, or subsidiaries, or any other third party (“the Owners”) and are protected by South African and international copyright laws. 

The Providers reserve the right to make any changes to the Website, the Content, or any products and/or services offered through the Website at any time and without notice. 

All rights in and to the Content are reserved and retained by the Owners.

Except as specified in these Terms and Conditions, the User is not granted a license or any other right including, without limitation under Copyright, Trademark, Patent, or other Intellectual Property Rights, in or to the Content.


Limitation of Liability

The Website and all Content on the Website, including any current or future offers or products, or services, are provided on an “as is” basis and may include inaccuracies or typographical errors.

The Owners make no warranty or representation as to the availability, accuracy, or completeness of the Content. Neither Provider nor any holding company, affiliate, or subsidiary of the Provider, shall be held responsible for any direct or indirect special, consequential, or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if the Provider is expressly advised thereof.


Privacy: Casual Surfing

The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User’s computer, but not the User’s email address or any other distinguishing information. This information is aggregated to measure the number of visits, the average time spent on the Website, the pages viewed, and so on.

The Provider uses this information to determine the use of the Website and to improve the Content thereon. The Provider assumes no obligation to protect this information and may copy, distribute, or otherwise use such information without limitation.


Choice of Law

This Website is controlled, operated, and administered by the Provider from its offices within The Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. 

The User may not use this Website in violation of South African export laws and regulations. 

If the user accesses this Website from locations outside of South Africa, that User is responsible for compliance will all local laws. 

These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Cape Town High Court in any event of any dispute. 

If any of these provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.

These terms and Conditions constitute the entire agreement between the Provider and the User regarding the use of the Content and this Website.
